A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant is a foreigner of Vietnam's nationality who has an internal relationship with the victim C (V, 34 years of age, Vietnam).

1. In October 2016, the Defendant forced indecent act: (a) made a conversation with the victim who was seated on the top of the driver’s car operation seat of the victim at a parking lot located in D at the time of domination on October 2016; and (b) made it possible for the victim to talk with the victim, who was able to do so; (c) “I will no longer have any family member; and (d) we will no longer be able to do so; and (d) I would like to have the victim’s chest on two occasions by his hand.”

Accordingly, the defendant forcedly committed an indecent act against the victim.

2. A special intimidation: (a) on October 29, 2016, the Defendant received a demand from the injured party of the Vietnam restaurant, “F” in the name of “F” located in Ison-si E, Leecheon-si, to return the vehicle’s key,” and (b) return it after drinking.

“Although the victim tolds that he was the Defendant’s hand, he saw the key of the said vehicle as the Defendant’s hand into the main restaurant, and saw the victim into the main room, and boomed the victim into the main room, and led the victim to a brupt, and sound “Itt yout yout yout yout yout yout yout you.”

Accordingly, the defendant carried dangerous objects and threatened the victim.

3. Violence;

A. On October 29, 2016, around 19:00 on October 29, 2016, the Defendant listened to the victim’s car that stopped in the front line of the lusent head of the mutually unfluent head state in Ischeon-si, Leecheon-si, that “I am off from the Hague, I am off from the vehicle” from the victim, and when I am scam the victim’s buck at one time as his hand.

Accordingly, the defendant assaulted the victim.

B. On November 13, 2016, around 15:20 on November 13, 2016, the Defendant refused a request from the victim for release of the Defendant’s phone number from the book number, even though he requested the victim to release the Defendant’s phone number from the book number, and the victim’s refusal to do so.
