A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

As a member of the Chinese telephone financial fraud organization, the Defendant: (a) induces an unspecified general public to deposit money in the large account by telephone call to misrepresenting the lending company’s staff or making a false statement as if he was a telephoneer’s family member; (b) soliciting the large account to be used for committing the crime; and (c) directing the Defendant to collect the large account and cash cards, etc. from the Defendant and withdraw the money by receiving information on the cash cards and the cash cards deposited into the delivery information and the large account; and (c) the Defendant, according to the above “C”’s instructions, conspireds each other to take charge of collecting the large account and cash cards, etc. from the Kwikset service article to deliver them directly or by mail, and to deliver them to the “C” by withdrawing the money from the deposited account.

1. Violation of the Electronic Financial Transactions Act;

A. On April 14, 2015, around 20:50, the Defendant: (a) 20:50, at the direction of “C” in front of the exit of the horse Park Station No. 2 in Gyeongcheon-si; (b) obtained a physical card connected to the bank account in the name of E from “C” (Account Number:F); and (c) one physical card connected to the bank account in the name of G (Account Number: H).

B. On April 15, 2015, at around 19:20, the Defendant: (a) received a copy of a physical card connected to the I’s new bank account (Account Number: J) in the name of D, one check connected to the K’s new bank account (Account Number: L), one check connected to the M’s string bank account (Account Number: N) in the name of D, one check connected to the string bank account in the name of B, and one check connected to the string bank account (Account Number:N) in the name of C, and one check connected to the O’s new bank account (Account Number).

C. On April 15, 2015, the Defendant: (a) around 19:20 on April 15, 2015, the Defendant’s PSS5 car parked in the front of the exit of 10 ridges located in Gwangjin-gu Seoul Special Metropolitan City.
