All appeals filed by the prosecutor against the Defendants are dismissed.
Reasons
1. The summary of the grounds for appeal in light of the developments leading up to the Defendants to saw the instant Gosaw and the Defendants’ gambling power, the facts charged in the instant case exceeded the level of temporary entertainment, but the lower court acquitted the Defendants of the facts charged in the instant case, thereby adversely affecting the conclusion of the judgment.
2. Determination
A. B. In full view of the following circumstances acknowledged by the evidence duly admitted and investigated, the lower court acquitted the Defendants on the ground that the Defendants were not guilty on the ground that it was limited to the extent of temporary entertainment and the evidence submitted by the prosecutor alone, which led to the Defendants’ act constitutes gambling beyond the degree of temporary entertainment.
① Defendant A had a meeting at the time and place indicated in the facts charged in the instant case in order to have a person to have a person to take part in a new-sex tour after having remarriedd, and the Defendants and the providers of the said places D, Gosawsaw E, F, etc. were well known to the general public.
② The Defendants and the meeting participants agreed to sing the two-lane singing and waiting for the remaining sings, as seen above, appears to have singsaw the singing costs.
