Reasons
1. Details of the disposition;
A. On August 20, 2017, the Plaintiff driven B vehicles while under the influence of alcohol at around 22:15, with a blood alcohol concentration of 0.128%.
B. Accordingly, on September 5, 2017, the Defendant rendered a disposition of revocation of a driver’s license (class I, class I, and class II ordinary) against the Plaintiff (hereinafter “instant disposition”).

2. Whether the instant disposition is lawful
A. In light of the fact that the Plaintiff’s alleged drunk driving did not cause personal injury, the Plaintiff was driving for 26 years with no accident, driving a short distance of about 20 meters, and driving a short distance of about 20 meters, and the driver’s license is required to keep a far distance from his workplace, the instant disposition exceeded the scope of discretion or abused discretion.
B. Whether such disposition is legitimate or not must be determined in accordance with the contents and purport of the relevant Acts and subordinate statutes, not only the above disposition criteria,
The disposition can not be said to be legitimate, but the above disposition disposition does not conform with the Constitution or the law itself, or a punitive administrative disposition in accordance with the above disposition disposition is the content and relation of the violation.
