1. The Defendant’s KRW 35,019,595 as well as 5% per annum from March 28, 2012 to May 13, 2014 to the Plaintiff.

1. Occurrence of liability for damages;

가. 인정사실 1) 원고는 2012. 1.경부터, 포항시 남구 C에서 ‘D’이라는 상호로 건설기계 부품을 생산하는 업체를 운영하는 피고에게 일용직 근로자로 고용되어 근무하였다. 2) 원고는 2012. 3. 28. 10:00경 위 작업장에서 산소절단기를 사용하여 절단작업을 하던 중 산소절단기를 잇는 튜브에 생긴 구멍(동료 근로자가 옆에서 그라인더로 사상작업을 할 때 튄 불똥 때문에 생긴 것으로 보인다)으로 산소가 배출되면서 화재가 발생하여 양쪽 허벅지에 화상을 입었다.

B. According to the above recognition of liability, the Plaintiff suffered the instant accident because the Defendant, an employer, did not perform its duty to protect the Plaintiff, who is an employee, by having the Plaintiff work at risk of a fire, and did not protect the Plaintiff.

The defendant is liable for compensating the plaintiff for damages caused by the accident in this case.
