The defendant's appeal is dismissed.

1. Of the facts charged in this case, the lower court dismissed the prosecution on the charge of assault, and the Defendant appealed only on the ground of unreasonable sentencing, and the prosecutor did not appeal the dismissal of the public prosecution as to the part on conviction, and thus, the dismissal of the public prosecution by the lower court was determined separately as it is, and only the guilty part falls under the scope of

2. The decision of the court below (one year of imprisonment) is too unreasonable in its summary of the grounds for appeal.

The judgment appears to have recognized the Defendant’s mistake and against the Defendant, the damage amount is relatively significant; however, the Defendant has much history of having been punished for the same crime, such as imprisonment with prison labor in 2009, imprisonment with prison labor in 201, with prison labor in 201, with prison labor in 201, with prison labor in 201, with prison labor in 201, with prison labor for a drunk driving in 2013, with prison labor in 1 year, with prison labor in 2013, and having been punished for a fine several times; the Defendant was sentenced to one year after the execution of the punishment in 2013, with prison labor in 2013; the Defendant committed the instant crime during the repeated period from one month after the completion of the sentence; the Defendant did not agree with the victims of the crime; the damage amount was not recovered; the Defendant’s blood alcohol level in relation to a drunk driving reaches 0.151%; the Defendant’s age, character and conduct, the circumstances of the instant crime; and the Defendant’s assertion is unreasonable.

4. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
