A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 5, 2016, at around 23:00, the Defendant expressed a bath to the effect that “C” located in Orasan City B is “I will not pay the drinking value” by the main shop D and that “I will not pay the drinking value.” On December 5, 2016, the Defendant sent to the slope F of the Hasung East Police Station E box, which was called out after receiving a report from the main shop D, and that “I will am fry, fry, fry, fry, fry, fry, fry, fry, frying G’s chest.”

As a result, the Defendant interfered with the legitimate execution of duties of police officers on the prevention, suppression and investigation of crimes.

1. Relevant Article 136 of the Criminal Act concerning the facts constituting an offense and Article 136 (1) of the Criminal Act concerning the selection of punishment;

1. Articles 40 and 50 of the Criminal Act of the Commercial Competition;

1. The reason for sentencing under Article 62(1)(the following favorable circumstances) of the Criminal Act was assaulted by the police officer who lawfully performed public duties, such as smugglinging the chest of the police officer.

This is highly responsible for serious infringement of public authority which should be strictly enforced.

On the other hand, the fact of crime is recognized and wrong.

The circumstances that seem to have been committed under the influence of alcohol are also recognized.

In full view of the above circumstances and other circumstances, the Defendant’s age, sex, environment, family relationship, motive and consequence of the crime, circumstances after the crime, etc., and the sentencing conditions specified in the instant pleadings, a suspended sentence of imprisonment shall be imposed on the Defendant.
