The defendant's appeal is dismissed.

1. The summary of the grounds for appeal is without any fact that the Defendant had a knife less than the back part of the victim, and the court below found the Defendant guilty of the facts charged in this case. The court below erred by misapprehending the facts and affecting the conclusion of the judgment.

2. The following circumstances acknowledged by the evidence duly adopted and examined by the lower court, namely, the owner of the E restaurant, the place of occurrence of the instant case, in the police investigation, led the injured party to desire and take a part in the Defendant, and the defect of the Defendant’s Nara, the Defendant’s Ma was frighting himself, and the victim was frighted out of the restaurant, and the victim was frighted.

The statement, the husband F of M was made by the defendant when he was present in the court of original instance, and the victim was on the side of the defendant's chest.

The statement is that the victim made a statement from an investigative agency to the court of the court of the court below, and that the defendant did so by cutting down his back less than his back and expanding outside a restaurant.

In full view of the consistent statements, and the explanation of the situation does not seem to be contradictory or inconsistent, and the CCTV extract photographs and evidence video CDs submitted appear to conform to the victim's statement, it can be recognized that the facts that the defendant inflicted bodily injury on the victim as stated in the facts constituting the crime in the judgment of the court below are recognized. Thus, the defendant's assertion of mistake is without merit.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
