A defendant shall be punished by imprisonment with prison labor for not more than ten months.

The request of the applicant for compensation shall be dismissed.

Punishment of the crime

[2019 Highest 2427] On May 10, 2019, between 00:30 to 05:00, the Defendant cut off 23 mobile phones over 23 times from the time on June 18, 2019 (attached Form 1) from the date on which the victim’s market price owned by the victim E located in Gangnam-gu Seoul, Seoul, with 600,000 Aphone X was stolen.

[2019 Highest 2665] On April 20, 2019, the Defendant stolen six mobile phones over a total of six times from the time until June 8, 2019 (attached Form 2) in the “G Sgallon” located in the Gangnam-gu Seoul F and the first underground floor, the victim H, who was diving, with one cellular phone of approximately one million in the market price of Samsung Ggalno Triart, owned by the victim H, and thereafter thefted with one mobile phone of approximately one million.

[2019 Highest 2916] On June 13, 2019, the Defendant: (a) at the “J” located in Songpa-gu Seoul Metropolitan Government I on June 13, 2019; and (b) at the market price of the victim K owned by the Defendant, the Defendant stolen it with one cellular thallonianos8 mobile phones owned by the victim K.

[2019Dadan3212] On September 3, 2018, the Defendant made a false statement to the effect that “The Defendant was liable to pay a mobile phone fee to the victim L via mobile phone M within four days if he/she borrowed money.”

However, at the time, the Defendant was in a bad credit condition without any particular property or income, and the Defendant was only liable for the debt to the person, so there was no intention or ability to repay the debt even if he borrowed the money from the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 1 million from the victim through a new bank account in the name of N, the Defendant’s seat.
