피고인은 보이스 피 싱 범죄조직의 지시 책 역할을 하는 위 D(‘ 위 챗’ 닉네임 ‘E’ )로부터 휴대폰 ‘ 위 챗’ 을 통해 지시를 받아, 2018. 3. 27. 11:10 경 서울 구로구 F에 있는 G 약국 앞 노상에서 보이스 피 싱 범죄조직으로부터 별도의 지시를 받고 그곳에 나온 H을 만 나 H 명의의 ① 국민은행 체크카드( 카드번호 : I), ② 신한 은행 체크카드( 카드번호 : J), ③ 우리 은행 체크카드( 카드번호 : K) 등 3 장의 체크카드를 건네받아 현금을 인출하기 위해 가져갔다.
