A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

On December 21, 2019, at around 22:55, the Defendant driven the said radar car with a blood alcohol concentration of 0.193%, and led to the flow of the four-lane road in front of Gwangju Seo-gu, Seo-gu, by three-lanes, from the viewing side to postal administration.

In this case, the driver has a duty of care to observe the signal and to prevent the accident by driving safely.

Nevertheless, under the influence of alcohol, the Defendant violated the signal even if the signal such as the front signal was a red light and went to the intersection automatically, and was driven by the victim D (28 years old) who was normally going to go to the left side from the right side of the running direction of the Defendant, and continued to go to the front part of the said radar car by the victim F(55 years old).

Ultimately, the Defendant suffered from the injury of brain-dead to the victim D due to the above occupational negligence in a situation where normal driving is difficult due to the influence of alcohol, for approximately two weeks, the injury of brain-dead in which there is no open room to treat the victim D for about two weeks; the injury of brain-dead in which there is no room to treat the victim H (age 42) who is the passenger of the said Bosch Rexton Sports Car for about two weeks; the injury of the victim F, for about two weeks, such as dratum salt, tension, and so on; and the injury of the victim I (age 28) who is the passenger of the said rocketing taxi, requires approximately two weeks of medical treatment.

2. A defendant who violates the Road Traffic Act (driving) shall be granted around December 21, 201 and around 22:5.
