A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 26, 2013, the Defendant received a summary order of KRW 1 million from the Incheon District Court to a fine for a violation of the Road Traffic Act (driving) and a summary order of KRW 2 million from the Incheon District Court’s Vice Branch on April 9, 2013 to a fine of KRW 1 million.

1. At around 04:50 on July 6, 2013, the Defendant: (a) operated a B-hurd vehicle with a blood alcohol concentration of about 0.142% without a vehicle driver’s license in the section of approximately 1.5 km from the road near the incheon-gu, Seocheon-gu, Seocheon-gu, Seoul to the front road of the citizen center of approximately 792-1 of the same Jung-gu, Jungcheon-gu.

2. A violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) committed on July 6, 2013, the Defendant, at around 04:50, 2013, driven by the victim C (Y, 31 years old) who was in the atmosphere signaled at the front of the Defendant’s vehicle while driving the frist vehicle in a difficult condition to drive normally, such as under the influence of alcohol, by driving the frist vehicle at the face of the face, and neglecting to drive the front road of the 792-1, Seocheon-si, Seocheon-si, Nowon-gu, Nowon-gu, Seoul Special Metropolitan City, the citizen center at the front of the 792-1, the head of the frith-gu, Seoul Special Metropolitan City, and neglecting to drive the friend and operation of the friend system.

As a result, the defendant driving a motor vehicle in a state where normal driving is difficult due to influence of drinking, and suffered from injury such as the c and the victim E (33 years old) who is the passenger of the damaged motor vehicle for about two weeks in need of medical treatment.
