A defendant shall be punished by imprisonment with prison labor for not more than ten months.

피고인은 2016. 9. 14. 02:40경 통영시 B에 있는 C 피시방에서, 미성년자가 인터넷 게임을 한다는 신고를 받고 현장에 출동한 통영경찰서 D파출소 소속 순경인 피해자 E이 단속하자, 자신의 친구가 운영하는 피시방을 단속한다는 이유로 화가 나, F 등 손님 약 20명이 듣고 있는 가운데 위 피해자 E에게 ‘야 이 개새끼야. 니는 뭐꼬. 씹할 놈아. 내가 니 선배다. 이 개새끼야. 씹할 놈아. 야 이 개새끼야’라고 큰 소리로 욕설하고, 위 D파출소 소속 경위 G으로부터 이를 제지당하자, ‘너는 뭔데. 나하고 한판 뜨자’라고 말하면서 오른손으로 위 G의 왼팔 소매를 잡고 2층에서 1층으로 끌어 내린 후 오른손바닥으로 왼쪽 팔목 부위를 1회 내리쳤다.
