피고인은 2013. 1. 1. 19:30경 경기 부천시 오정구 고강동에 있는 볏집삼겹살 식당 앞 도로에서부터 같은 동 350-13호 앞 도로에 이르기까지 약 50ｍ 구간에서 혈중알콜농도 0.271%의 술에 취한 상태에서 B 마티즈 승용차를 운전하였다.
