A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. In order to raise funds for gambling at a private sports gambling site, the Defendant was willing to obtain money from many unspecified persons on the Internet by iceizing the sales of mobile phones.

However, the defendant did not have a mobile phone to sell, and the defendant thought that he/she will receive money from the injured party to use it as a gambling fund, so there was no intention or ability to deliver his/her mobile phone to the injured party.

Nevertheless, the Defendant was issued KRW 11,480,000, in total, from 38 victims, as shown in the Attachment Table 1, from around that time to March 18, 2018, including the receipt of KRW 360,000 from the victim’s corporate bank D account on the same day from the victim C, to the Defendant’s corporate bank account on the same day.

2. A person, other than the Seoul Olympic Sports Promotion Foundation and an entrusted business entity, shall not gambling by taking advantage of an act of offering property or property benefits to a person who has correctly predicted the result of sports promotion by issuing voting rights or things similar thereto;

On January 10, 2018, at around 00:37, the Defendant sent KRW 70,000 to the post office 61034,50241 account in the name of a limited company affiliated to the above site, which is a private sports gambling site, from the mutual influent pc room located in Busan Seosan-dong, (E) the Defendant’s private sports gambling site.
