Reasons
Punishment of the crime
1. From February 2013 to early 2014, Defendant A operated the Nsite via the Internet, Defendant: (a) received the transfer of KRW 50,00 to 200,000 from the nationwide sexual traffic business establishments via the Internet; (b) posted information such as the location, contact address, price, etc. of a nationwide sexual traffic business establishment on the said Nsite; and (c) put an advertisement to place an “after-use” on the advertisement site of a nationwide sexual traffic business establishment, such as O, upon receiving KRW 100,00 from the police officer from early 2014 to January 8, 2015.
Accordingly, the defendant advertised business places where commercial sex acts or arrangement of commercial sex acts are conducted.
2. On December 2013, Defendants C, B, and D established Q Q via the Internet at the 6th floor office of the building in Yongsan-si Paea District P, and Defendant C, based on the materials (location, photograph of employees, telephone number, etc.) received from the affiliated companies, provided that the suspension of business was allowed to display advertisements on the Q site. Defendant B, by phone with the person in charge of the commercial sex acts, played the role of collecting cooperation expenses, and Defendant D, by advertising the Q site on the portal site such as Gogle.
The Defendants received KRW 100,00 to 200,00 from December 2013 to January 7, 2015 through the above Q site from the above office via the said Q site, and then placed the location, telephone number, and employees information of the commercial sex acts business establishment on the said Q site, and let many unspecified men prepare a post-scoping, etc. The Defendants advertised to introduce commercial sex acts business establishments to the said Q site. The Korea Communications Standards Commission deliberated on the illegal site and cut off the said Q site to change the address of the Q site.
