1. Of the distribution schedule prepared by the said court on October 23, 2014 in the Hayang District Court’s Hayang Branch distribution procedure case.
Reasons
1. Basic facts
A. On August 27, 2013, the Plaintiff entered into a subcontract and an agreement on direct payment 1)
As between the Corporation and the Corporation, the Corporation for the Construction of New Facilities (hereinafter referred to as “the Construction of this case”) in which the Republic of Korea (the District Department No. 2 of the Navy) ordered and contracted for the Construction of Epir, Pyeongtaek-Seoul-Y-15 Training Center located in Pyeongtaek-Eup.
(B) The subcontract agreement of the construction project (hereinafter referred to as “the subcontract agreement”) to be accepted in the amount of KRW 496,870,000 (including value-added tax) of the title, metal, windows, and swimming works among them is subject to the instant subcontract agreement.
(2) On August 27, 2013, the Plaintiff agreed to pay KRW 496,840,000 to the Plaintiff, the subcontractor, who is the ordering person, as the subcontractor.
3) According to the aforementioned direct payment agreement, the Plaintiff received a total of KRW 301,347,560 from the Republic of Korea, and completed the subcontracted construction work. (b) Korea deposited and distributed the subcontracted construction work. (c) On May 22, 2014, following the Plaintiff’s completion of the subcontracted construction work, the Plaintiff entered into a direct payment agreement with the 8 sewage-based subcontractor, including the Plaintiff, and the Plaintiff entered into an agreement with the 301,347,560 won for the payment of the construction work. From September 16, 2013 to May 12, 2014, the Plaintiff deposited the Plaintiff’s creditors, the debtor construction, the obligor’s provisional attachment order of claims against the Republic of Korea, claims seizure, and collection order, and deposited the instant construction work price under the instant contract with the 21,2014 government-funded District Court No.1903, May 22, 2014.
2 The distribution procedure for the said deposit shall be the Hayang Branch of the District Court in order to pay the said deposit.
