A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From July 2018 to August 21, 2018, the Defendant is the owner of a game room operating “C” located on the first basement of Geumcheon-gu Seoul Metropolitan Government, Geumcheon-gu, and D is the employee of the game room in charge of the duties of exchanging the points obtained through the game in cash from August 17, 2018 to August 21, 2018.

1. No one who provides game products the contents of which are different from the classified game products shall provide such game products for use, the contents of which are different from those of the game products management committee;

Nevertheless, from July 2017 to August 21, 2018, the Defendant installed 50 game machine of “E” game products, which are game products classified in the above “C” game room, and provided them for the use of customers. Nevertheless, the Defendant provided them for the use of customers by adding the function of eliminating accumulated points of the game card stored in the IC card using a separate external device that does not exist in the classified contents, and the separate card settlement function.

As a result, the Defendant provided game products with contents different from those of the rating in addition to the function of exchanging points accumulated to customers and enabling them to exchange through the elimination of points.

2. No one shall engage in the business of exchanging or arranging exchange or repurchase tangible or intangible results obtained through the use of game products by any person who has possessed such results of a game.

Nevertheless, the Defendant invited D and customers to exchange points obtained through the use of the above “E” in cash, and D, according to the above public offering, from August 17, 2018 to August 21, 2018, shall convert the accumulated points obtained by the customers who find the above game site from August 17, 2018 to August 21, 2018 into cash per one point, deduct 10% from exchange fees.
