1. Defendant A

(a) The defendant shall be punished by imprisonment without prison labor for four months;

(b)Provided, That the above punishment shall be imposed for one year from the date this judgment became final and conclusive.

Punishment of the crime

1. Defendant A is a person who is engaged in driving of a cargo bareboat.

On March 5, 2016, the Defendant driving the above vehicle at around 02:52, and driving a four-lane road in the fransh-dong, Seo-gu, Seo-gu, Seo-gu, Gwangju, according to three-lanes from the franch reservoir to the 518 Parkside, and changed the course to the four-lane.

In such cases, when it is likely that a person engaged in driving service will impede normal traffic of other vehicles running in the direction of changing course, he/she shall not change course, and he/she has a duty of care to give prior notice of change of course due to the direction point time, etc., to live well before and after the direction point, to accurately operate steering devices, brakes, etc. and to change course safely.

Article 19(3), 38(1), and 48(1) of the Road Traffic Act (see, e.g., Articles 19(3), 38(1) of the Road Traffic Act). (3) The driver of any motor vehicle shall not change its course when it is likely to impede normal traffic of other motor vehicles running in the direction to which he/she intends to change his/her course.

Article 38 (Signals of Vehicles) (1) The driver of any motor vehicle shall, when he/she intends to turn to the left, turn to the left, cross the road, drive slowly, stop the motor vehicle slowly, stop the motor vehicle in the same direction or intends to change the course while proceeding in the same direction, make a signal with his/her hand, direction indicator or light until the act is completed.

Article 48 (Duties of Safe and Eco-Friendly Driving) (1) The driver of any motor vehicle shall accurately operate the steering system, brakes and other devices of his/her motor vehicle and shall not drive his/her motor vehicle at a speed and in a manner that may cause danger and impediment to other persons according to the traffic conditions of the road and the structure and performance of his/her motor vehicle.

Nevertheless, the defendant neglected this and has changed the course to a four-lane.
