Criminal facts

On September 7, 2013, at around 02:19, the Defendant, at the main point of “D,” located in Kimhae-si, Kim Jong-si, a middle school E (n, 23 years of age) and drinking, followed the victim’s mind to the extent that the victim lost his body under the influence of alcohol.

이에 피고인은 만취한 피해자를 부축하고 같은 날 02:35경 김해시 F에 있는 피고인의 집인 G아파트 205동 1008호로 데리고 가, 피해자의 팬티와 브래지어를 벗긴 후 그 위에 올라타 피해자에게 키스하고, 피해자의 가슴을 핥은 다음 항거불능의 상태를 이용하여 피해자를 간음하려고 하였으나, 정신이 든 피해자가 온 힘을 다해 발버둥치면서 “하지 마라, 한 번만 살려 달라.”라고 소리치며 피고인을 밀쳐 내었고, 이에 피고인은 피해자가 움직이지 못하도록 몸을 누르며 손으로 입을 막은 뒤 피해자를 계속하여 간음하려 하였으나 피해자를 찾는 전화가 계속 오자 간음하려는 것을 그만둠으로써 미수에 그치고, 그 과정에서 피해자에게 약 2주간의 치료가 필요한 요추의 염좌 및 멍 등의 상해를 입게 하였다.
