A defendant shall be punished by imprisonment for three years.

Punishment of the crime

On November 2, 2012, the Defendant was sentenced to imprisonment for a violation of the Act on the Regulation of Conducting Fund-Raising Business without Permission at the Daegu District Court on April 3, 2013 and completed the execution of the sentence.

C The representative of “D” and the president of “D”, a similar-receiving private company, which is a fund-raising private company, to guarantee the 20% high profit monthly investment in the gold transaction business, who have overall control over the crime of this case. E, the president of the board of directors of the above company, who has overall control over the job explanation and the receipt of money for the victims of this case, and the defendants (F), G, H, and I, as the directors of the above company, have led the victims of this case to explain the business and receive money together with E.

1. No person who violates the Act on the Regulation of Conducting Fund-Raising Business without Permission, etc. shall make an agreement to pay the full amount of investments or an amount in excess thereof to an unspecified number of persons in the future without permission, etc. from the authorities, and shall make any “money-raising business without permission, etc

Nevertheless, the Defendant, without obtaining authorization, permission, etc. from authorities together with C, E, I, G, H, etc. from March 27, 2015 to December 15, 2015, explained to the effect that “When investing money in D’s gold trading business, the Defendant would use such money for the gold trading business and pay the principal and 20% profit within the month during which the said money was paid out of the enormous profit.” The Defendant received total of KRW 100 million from the victim K under the pretext of investment, including KRW 40 million around November 28, 2015, KRW 30 million around September 30, 2015, and KRW 100 million from September 15, 2015 to September 37, 2015, and KRW 300 million from September 15, 2015 to September 28, 2015 to September 30, 2015.
