Defendant
A shall be punished by imprisonment for a period of two years and four months, and by imprisonment for a period of one year and one hundred months, respectively.
Reasons
Punishment of the crime
In China, E and E, in order to make an additional loan by misrepresenting the people of the Republic of Korea to make a telephone call in the area of the Chinese Cheong City area, F conspired with the victims to acquire money from the victims by deceiving the victims, and to recruit the co-offenders of the nationality of the Republic of Korea who are to make a telephone call by misrepresenting the people of the Republic of Korea through G (no, human information) and H.
1. On November 2014, Defendant A proposed to commit a crime against the Defendant in accordance with the above conspiracy, and the Defendant resided in the Cheongyang-gu Incheon Metropolitan City I apartment complex with G, etc. in response thereto, while managing the overall crime as president, and the Defendant: (a) provided the victims in Korea with education on the method of phone calls, etc.; and (b) provided direct conversations with the victims suspected of committing the crime; (c) Defendant A, J, K, L, M, N, N,O, P, etc. by calls from the victims in Korea by misrepresenting them; and (d) conspired to prevent fraud by withdrawing the money by means of cash withdrawal measures.
On November 10, 2014, in accordance with the above public offering, the Defendant misrepresented the Defendant’s agent for Hyundai Capital Scion by converting the victim Q Q into the phone number, and misrepresenting him/her to make a loan, and falsely concluding that “In order to make a loan, he/she has to partially repay part of the loans previously available in the U.N., and in order to do so, he/she received 1,000,000 won from the victim to the corporate bank account in the name of T-based managed by the accomplice on the same day, and then, from around that time to July 28, 2015, he/she deceivings 27 victims by the same method as shown in attached Table 1 of the daily list of crimes, and deceivings them from the victims in total 75 times from the victims, thereby deceiving 161,018,107 won.
