A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. In such cases, drivers have the duty of care to accurately operate the steering system, brakes, and other devices of the vehicle, and to prevent accidents due to the failure to drive at a speed or in a manner that may cause danger and harm to others according to the road traffic situation and the structure and performance of the vehicle.

Nevertheless, under the influence of alcohol, the Defendant neglected the duty of care in the front, and failed to properly operate the brake system, and was driven by the victim D(31 years of age) who is waiting in the front section of the vehicle, and was driven by the Defendant as the front part of the vehicle.

Ultimately, the Defendant, as seen above, driven the said K7 car in a situation where normal driving is difficult due to influence of drinking, and suffered injury to the victim, such as culp salt for about two weeks in need of medical treatment.

2. The Defendant, while under the influence of alcohol 0.124% at the time and time set forth in paragraph (1), driven the said BK7 car from the F apartment at the original city to the front road at the construction site of the same city.
