1. The Plaintiff:

A. The Defendants are jointly and severally liable to pay KRW 50,000,000 and each year from May 16, 2015 to October 2, 2015.

1. Determination as to the cause of claim

A. Fact 1) The Plaintiff is the chief inspector of the “I” inspection located in the Ulsan-gu Northbuk-gu H. 2) Defendant C is the wife of Defendant B, and is the representative director of Defendant D.

3) On June 5, 2013, Defendant B determined the due date from the Plaintiff on July 12, 2013 as the due date for reimbursement from the Plaintiff (hereinafter “the instant loan”). The loan amount is KRW 70 million.

On November 21, 2013, Defendant B borrowed KRW 8 million to the Plaintiff for the interest on the instant loan or delay damages. (4) Defendant B agreed on March 31, 2014 and the Plaintiff and Defendant B agreed that “the instant loan amount of KRW 70 million shall be paid up to April 30, 2014,” and Defendant C and D guaranteed Defendant B’s debt at that time.

5) Defendant B paid KRW 2 million on July 3, 2014, and KRW 10 million on July 7, 2014, to the Plaintiff for the interest on the instant loan or delay damages. On November 7, 2014, Defendant B paid KRW 20 million to the Plaintiff for the principal of the instant loan. Defendant B paid KRW 60 million to the Plaintiff on August 7, 2013 and around July 25, 2014, upon Defendant B’s request.

7) On April 25, 2015, the Plaintiff and Defendant B agreed that “The principal amount of the instant loan shall be KRW 50 million and KRW 2 million shall be paid until May 15, 2015 of the instant loan” (hereinafter the instant agreement).

Defendant E, F, and G had jointly and severally guaranteed the above obligations of Defendant B at that time. [The facts that there is no dispute over the grounds for recognition, Gap 1-6 evidence, the purport of the entire pleadings, and the purport of the whole pleadings.]

B. The Plaintiff is jointly and severally liable for determination: (a) the Defendants are jointly and severally liable for payment of KRW 50 million in the balance of the principal of the instant loan and KRW 50 million per annum from May 16, 2015 to October 2, 2015, which is the last delivery date of the complaint; and (b) the interest rate of KRW 15 percent per annum from the following day to the day of full payment; and (c) Defendant B, E, F, and G jointly and severally liable for the payment of KRW 2,00,000 in the instant loan and the interest thereon.
