Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a person who is engaged in driving a passenger car in B SP area.

1. On September 1, 2018, the Defendant: (a) driven the said vehicle under the influence of alcohol with a blood alcohol concentration of 0.09% at a distance of about 200 meters from the upper right of the C building in the city of Heung-si to the front distance of D in the city of Heung-si, in around 10:21, 2018.

2. On September 1, 2018, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (hereinafter “Special Cases Concerning the Settlement of Traffic Accidents”) driven the said vehicle and proceeded to turn to the left at the speed of about 20 km from the Silung National Sports Center to the Silung National Sports Center at the speed of about 10 km.

It is a place where signal lights and crosswalks are installed. In such a case, there was a duty of care to safely proceed after checking whether a person engaged in driving a motor vehicle is a pedestrian crossing the road as well as a pedestrian crossing the road.

Nevertheless, the Defendant neglected to make a left-hand turn while under the influence of alcohol, and caused the victim E (the age of 62) who dried the crosswalk at the right-hand side in the direction-hand side of the course when the pedestrian signal is red, to the right-hand side.

As a result, the Defendant suffered injury, such as the mouth of the body body in light of the body body body, accompanied by the right pelvis, which requires treatment for approximately 12 weeks, due to the above occupational negligence.
