The prosecutor's appeal is dismissed.

The summary of the grounds for appeal: ① The victim E, witness F, the police officer, and each statement at the court of original instance are consistent and inconsistent with each other as to the circumstance where the defendant and the victim were to be punished for vision; the content and degree of the assault inflicted by the victim; the degree of damage inflicted by the victim; the situation after the police officer arrived at the scene; ② the victim’s speech from the defendant that “the husband of the defendant's husband is prone” was unfacing, and so long as the victim was not a victim of severe assault by the defendant, it would be normal to mainly talk about the above insulting words to the police officer dispatched to the scene, and thus, it is difficult for the victim to view that there was no credibility at the time of arrest of the victim as a suspect immediately after the occurrence of the case: ⑤ The victim’s statement that was made to the police officer before he was arrested as a flagrant offender at the time of interrogation; ④ The victim’s statement that it was difficult for the victim to have arrived at the scene only because he was arrested by the police officer at the time of interrogation.
