A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 2018, the defendant, who is dissatisfied with the problem of parking B (the age of 62) and the victim's office, has been investigated twice as a suspicion of damaging goods owned by the victim, etc., and filed a summary order.

피고인은 2018. 11. 1. 17:40경 서울 영등포구 C에 있는 피해자 운영의 ‘D’ 사무실 안에서, 피고인이 들어오는 것을 본 피해자로부터 “그냥 나가라. CCTV로 다 찍고 신고하겠다.”라는 말을 듣고 화가 나, 피해자에게 욕설을 하며 주먹을 쥔 상태에서 손가락 부분으로 피해자의 이마 부분을 수회 때리고, 피해자 코 윗부분을 한차례 때렸다.

이어서 피고인은 피해자에게 “개새끼야. 너 때문에 벌금 물게 생겼다. 또 112에 신고해라. 내가 너 죽인다. 나는 중국가면 그만이다. 깡패 사서 너 죽이고 바다에 수장 시키면 끝이다.”라고 말하며 그곳에 있는 철제 의자를 들고 내리치려는 시늉을 하고, 책상 위에 있는 유리잔으로 책상을 수회 내리쳤으며, 그곳에 찾아온 손님을 밖으로 내보내는 등 약 20분 동안 소란을 피웠다.

Accordingly, the Defendant assaulted the victim as above and interfered with the operation of the victim's administrative agent office by force.
