A around 12:29 on October 16, 2018, when the originals of the child care center in question use play equipment, such as the indoor antiscopher, he/she neglected his/her duty of care to supervise the originals so that the originals do not go out of balance or do not cause any other reason, and thereby prevent the safety accident, and thereby, he/she neglected the duty of care to prevent the occurrence of the accident. However, in the situation where the originals, including the victims, are playing in the vicinity of the indoor antiscopher, he/she entered the infant care room in order to ensure the safety of the originals, such as supervising the originals, or instruct his/her teachers to do so, he/she did not perform the duty of care, thereby causing the victim to suffer injury, such as the number of days of treatment, by leaving the part of the indoor antiscopher, in excess of balance with other originals.
As a result, the Defendants conspired to inflict an injury on the victim by negligence in the course of business.
