A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

In around 2013, the Defendant came to know of the Victim B through Internet games around 2013, and around that time, the victim was named as “C” and his occupation was a golf instructor from the promoer’s origin, a high-priced external vehicles, and was living in high-class apartments.

On August 20, 2015, the Defendant, at the “E” bank located in Songpa-gu Seoul, Songpa-gu Seoul, sent a phone to the victim who believed the Defendant to be “C” as a golf instructor from promoer, and sent the victim the victim’s name to “C” and his/her photograph changed his/her photograph to another female photograph of the mother’s mother’s mother’s mother’s photograph, etc. before receiving KRW 6,00,00,000 from the victim on September 13, 2016.

However, in fact, the Defendant was not a golf instructor from a prolleyer, operated high-priced external vehicles, and did not reside in a high-class apartment. Since there was a circumstance that the Defendant did not have any property under the name of the Defendant and did not prepare living expenses due to the lack of monthly income and the change of monthly income, there was no intention or ability to complete payment even if he borrowed money from others.

On August 20, 2015, the Defendant received 400,000 won in total from the victim to the G Bank account (H) account in the name of the Defendant, and received 24,850,000 won in total over 30 times from around that time to January 27, 2017 in the same manner as the list of crimes in the attached Table.

Accordingly, the defendant deceivings the victim and defrauds 24,850,000 won in total.
