A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant's information about the defendant shall be made through an information and communications network for three years.

Criminal facts

On March 24, 2016, a defendant and a person to whom an order to attach an electronic device was requested (hereinafter referred to as "defendant") was sentenced to two years of imprisonment for violating the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Indecent Act by force against persons with disabilities) at the Southern District Court's Southern District Court on March 24, 2016, and the execution of the sentence was terminated on September 12, 2017. On December 13, 2018, the Gwangju District Court sentenced ten months of imprisonment for a crime of violation of the Road Traffic Act (unlicensed Driving) at the Gwangju District Court on April 19, 2019.

(Criminal Facts)

1. At around 15:20 on December 9, 2018, the Defendant: (a) operated the Defendant’s vehicle on the Cgallon II B road along the Gallon-gun, Masung-gun; (b) obstructed the said vehicle due to the breakdown of the vehicle; (c) laid off the said vehicle on the front line of the said vehicle; (d) laid off the victim’s seat, seated on the driver’s seat in the said vehicle; (c) laid off the victim’s seat in the front line with the victim’s body; and (d) committed an indecent act by force, such as leaving the victim’s will and clothes with the victim’s hand, and leaving the victim’s body by hand.

2. On December 9, 2018, the Defendant violated the Road Traffic Act (unlicensed driving) at around 2:20, the instant gals-II bomb, without obtaining a driver’s license in approximately 30 km section from the front day of the F in the Magsung-gun E via H restaurant located in the same Gun G to the same Gun B roads.

[The Defendant committed an indecent act by accessing the victim with a intellectual disability and the same-sex victim on March 24, 2016, such as committing an indecent act on the victim’s sexual organ in a rare place, etc. on the ground that he/she committed an indecent act on the victim’s sexual organ at a locationd place, etc., by violating the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Act by force by force of persons with disabilities), etc., on September 12, 2017. The Defendant completed the execution of the sentence on September 22, 2017, and was under execution of an electronic device attachment order from September 22, 2017.
