1. The sales contract concluded on December 2, 201 between Defendant A and C with respect to the real estate indicated in the separate sheet is KRW 25,00,000.

1. Facts of recognition;

A. On May 26, 2010, the Plaintiff entered into a contract with D (hereinafter referred to as “D”), setting the amount as KRW 18,150,00,00 each between May 27, 2010 and May 26, 2013, to guarantee the repair of defects under the construction contract entered into between D and D (hereinafter referred to as “instant guarantee contract”), and C, the actual operator of D, jointly and severally guaranteed the obligation owed by D to the Plaintiff under the instant guarantee contract.

(b) D shall be the same for foods that have taken place in 2012.

On September 24, 2012, the occurrence of the instant insurance accident under the instant guarantee agreement was caused due to the failure to repair the defects that occurred as a result of the construction work performed under the construction contract as described in the instant clause, and food so caused was claimed to the Plaintiff for the payment of insurance proceeds under the instant guarantee agreement, and received KRW 18,150,000 from the Plaintiff on November 1, 2012.

C. On December 2, 2011, C entered into a contract with Defendant A to sell KRW 80,000,000 as the sole property (hereinafter referred to as “instant real property”) to Defendant A (hereinafter referred to as “instant sales contract”) and completed the registration of transfer of ownership to Defendant A as of December 2, 201, with respect to the instant real property as of December 2, 201, Gwangju District Court Decision 55760, supra.

As of October 1, 2015, Defendant A entered into a contract with Defendant B to sell the instant real estate in KRW 80,000,000,000, and completed the registration of ownership transfer to Defendant B as of October 6, 2015, with respect to the instant real estate as of the receipt on October 6, 2015.

E. The Plaintiff filed against D and C pursuant to the instant guarantee agreement with the Gwangju District Court 2013Kadan37918.

The plaintiff filed a lawsuit claiming the payment of the amount repaid on behalf of the plaintiff, such as the statement in this paragraph, and the above court accepted the plaintiff's claim on September 24, 2013.
