A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2018. 12. 1.경부터 2019. 2. 19.경까지 광주 북구 B에 있는 ‘C’에서 요양복지사로 근무한 사람으로, 2019. 3. 7.경 전남지방노동위원회에 ‘위 요양기관의 사회복지사 D이 윽박질러 겁이 나서 어쩔 수 없이 사직원에 서명을 하게 되었다는 등 부당해고를 당하였으니 피고인을 복직시키고 해고기간에 받지 못한 임금을 지급받게 해 달라’는 부당해고 구제신청을 하면서 위 요양기관의 원장 E, 사회복지사 D에게 불만을 품게 되었다.

1. Around May 29, 2019, the Defendant, at the Defendant’s house located in the Seoul Northern-gu F building G, drafted a false copy of the content of E and D using a computer.

The authenticity is that “the defendant made an application for remedy against unfair dismissal to the Jeonnam Regional Labor Relations Commission,” and that “D, by forging the defendant’s resignation, forged the defendant’s resignation and shipped it to the above Labor Relations Commission.” The content or fact that “E, D, as a crime of forging private documents, or uttering of an investigation document, demands punishment for the crime of forging private documents,” was directly signed by the defendant to resign, and E, and there was no fact of forging the resignation under

Nevertheless, the defendant submitted the above written petition to police officers in the Gwangju Northern Police Station located in 172 (Oeo-dong) Seo-ro, Gwangju Northern District.

2. Around August 15, 2019, the Defendant submitted a complaint with knowledge of the fact that the case referred to in paragraph 1 was closed by the police, and prepared a false complaint with respect to E and D using a computer at the above Defendant’s home.

A written complaint is that "the defendant filed an application for unfair dismissal with the Jeonnam Regional Labor Relations Commission, and Eul forged the defendant's resignation and then shipped the defendant to the above Labor Relations Commission." The contents or facts of "E, D, as a crime of forging private documents, or the crime of uttering of the above investigation document," and "E, and D, as the defendant signed directly to the resignation source, have forged the resignation source under the name of the defendant."
