Punishment of the crime

[criminal history] On October 12, 2016, the Defendant was sentenced to one year of imprisonment and two years of suspended sentence for a violation of road traffic law at the Daejeon District Court on the grounds of a violation of road traffic law (drinking), and the above judgment became final and conclusive on May 19, 2017.

[Criminal facts]

1. On November 19, 2017, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Assault, etc. against a driver) committed an injury to the victim’s right side of the road of the Seo-gu Incheon Metropolitan City, where the victim K (59) was moved to the back seat of the victim K (59) at around 08:00 on November 19, 201, when he/she was moving to the back seat of the victim K (59) in front of the Sungsung-gu, Seo-gu, Seo-gu, Seoul Special Metropolitan City, when he/she was moving to the back seat of the victim, and without any reason, he/she suffered from the victim’s injury, such as the victim’s face at least three times, and the victim’s face requiring medical treatment for 14 days.

Accordingly, the defendant assaulted the victim who is a driver of a vehicle in operation and caused the injury.

2. 각 공무집행 방해 피고인은 2017. 11. 19. 08:17 경 대전시 유성구 M에 있는 N 노래방 건물 2 층 계단에서, 제 1 항과 같은 폭행 피해 신고를 받고 출동한 대전 둔 산 경찰서 O 지구대 소속 경찰관 P(48 세) 과 같은 소속 Q(30 세) 이 피고인에게 인적 사항과 사건 경위를 질문하자, 위 경찰관들에게 “ 아 씨 발 놈 아, 뭔 데 난 개새끼야 길에서 아무도 까도 돼, 너 같은 경찰새끼는 멱을 따 버린다 ”라고 욕설을 하면서, 머리로 위 Q의 가슴 부위를 2회 들이받고, 이에 옆에 있던 위 P이 피고인을 제지하자, 발로 P의 배 부위를 3회 차고, 다시 발로 Q의 오른쪽 허벅지 부위를 1회 찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the prevention, suppression, investigation, etc. of police officers' crimes.
