1. The part against the defendant in the judgment of the court of first instance shall be revoked, and the plaintiff's claim corresponding to the revoked part shall be dismissed.

1. Basic facts

가. 원고는 ‘D’라는 상호로 안산시 단원구 C 건물 6층에서 사우나, 7층에서 찜질방을 각 운영하고 있는데, 2006. 6. 29. G에게 위 찜질방 내에 있는 스낵코너(이하 ‘이 사건 스낵코너’라 한다)를 임대차보증금 2억 원, 월 차임 225만 원에 임대한 후 다시 그 관리를 위탁받아 운영하였다.

나. 피고는 2007. 12. 1.부터 2009. 5. 31.까지 이 사건 스낵코너를 점유하면서 음료수, 샌드위치, 삶은 계란 등을 판매하는 영업을 하였다.

C. On December 24, 2008, the Defendant entered into a real estate transfer contract (hereinafter “instant transfer contract”) with the Plaintiff with respect to the E large 595 square meters of land owned by the Defendant (hereinafter “instant land”). The main contents are as follows.

4) 양도인의 양도소득세는 원고가 부담하기로 한다. 5) 매매가 완료되면 원고는 이 사건 스낵코너에 대한 임대차계약서를 체결하기로 하고, 동 주소지 503호, 506호의 취득세 미납금은 원고가 책임지고 지불하기로 한다.

스낵코너 임차금액은 3억 6,500만 원(보증금, 시설비, 물품대 포함)으로 한다.
