A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On June 8, 2012, the Defendant was sentenced to one year of imprisonment and a fine of one million won at the Seoul Eastern District Court for fraud, etc. and completed the execution of the sentence in Seongdong-gu District Court on March 26, 2013.

1. On March 1, 2014, around 05:27, the Defendant, at the “EPC” operated by the victim D in Yangsan-si C, acted as if the victim would use the PC and pay the fee.

However, there was no intention or ability to pay the charges even if the defendant uses the PC from the beginning because there was no cash or credit card held by the defendant at the time.

The Defendant provided the said PC services from the victim, and did not pay KRW 13,200,00, while using the PC for about 13 hours from around that time to around 18:34 of the same day.

Accordingly, the defendant, by deceiving the victim, obtained pecuniary benefits equivalent to 13,200 won.

2. On October 14, 2013, the Defendant: (a) acted in the “HPC bank” operated by the victim G in the wife population F in Young-si, G on October 14, 2013; and (b) acted as if the victim would use the PC and pay the fare.

However, there was no intention or ability to pay the charges even if the defendant uses the PC from the beginning because there was no cash or credit card held by the defendant at the time.

The Defendant provided the said PC services from the victim and did not pay KRW 11,000,00, while using the PC for about 11 hours from around that time to around 08:31 on the following day.

Accordingly, the defendant, by deceiving the victim, acquired property benefits equivalent to 11,000 won.

3. On March 6, 2014, around 03:00, the Defendant used PC to the victim and acted as if he would pay the charge to the victim at K Pcck, where the victim J (29 years of age) working in Busan Shipping Daegu.

However, there is no money that the defendant has at the time.
