A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The defendant is a person engaged in driving a motor vehicle with a hurburged vehicle B in violation of the Aggravated Punishment Act;

On November 22, 2013, around 21:40, the Defendant driving the said vehicle at a three-lane between the two-lane in the direction of the Goyang-dong Labor Welfare & Labor Foundation in consideration of the shape of the road, and driving the said vehicle at a 0.153% alcohol concentration while under the influence of alcohol.

At the time, since it was night and there are many traffic of vehicles near the intersection, there was a duty of care to drive safely safely by thoroughly and accurately adjusting the steering direction and operation system.

Nevertheless, the Defendant neglected to perform the above duty of care in the situation where normal driving is difficult due to influence of drinking, and due to the negligence of driving the vehicle in front of the driving direction, and received the parts, such as Dunstren vehicle 1, 201, 201, 201, 201.

The Defendant, in violation of the Road Traffic Act, driven the above Ampurged vehicle in the state of alcohol 0.153% of the blood alcohol concentration at a section of about 250 meters from the 250-meter radius from the front side of the Yangyang-dong, Yangyang-dong, Busan, and Fisheries, to the place where the said accident occurred.
