Punishment of the crime

1. On August 15, 2015, the Defendant driven C Lasttoon vehicles from the front of the Hoam 2 tunnel in Geumcheon-gu, Geumcheon-gu, Seoul, to the front of 793-ro 793, while under the influence of alcohol from around 22:30 to 22:38, while under the influence of alcohol, the blood alcohol concentration of 0.112%.

2. 특수협박 피고인은 위와 같은 날 22:30경 같은 구 시흥동에 있는 호암2터널 앞 도로에서 안양 방면에서 서울 방면으로 위 차량을 운전하여 진행하고 있을 때 피해자 D(29세)이 운전하는 E K5 차량이 피고인 차량의 진행을 방해하였다는 이유로 위험한 물건인 피고인 차량의 상향등을 켠 상태로 피해자가 운전하는 위 K5 차량을 추격하고, 같은 날 22:38경 같은 구 금하로 793 벽산아파트 앞 도로에 이르러 피해자의 차량이 유턴하려 하자, 피고인의 차량을 피해자의 차량 앞에 세운 후 운전석 창문을 열어 피해자를 향해 손가락질을 하고, 다시 피해자의 차량이 진행하려 하자 재차 그 앞을 피고인의 차량으로 가로막아 피해자의 차량을 진행하지 못하게 하였다.
