1. The plaintiff operates the D Job Placement Service, and the defendant operates the D Job Placement Service F in the area located in Gangdong-gu Seoul Metropolitan Government E (hereinafter "the instant leap site").

On December 2015, the Defendant asked the Plaintiff to arrange for a female engaging in sexual traffic at the instant leaps, and on December 26, 2015, the Plaintiff provided the Defendant with the instant leaps at the instant leaps.

Accordingly, the Defendant paid KRW 2 million to G as a pre-paid payment, and paid KRW 14 million as of January 4, 2016. On that day, G and the Plaintiff issued to the Defendant a promissory note (hereinafter “instant promissory note”) with “ issuer G, Plaintiff, Defendant, and the Plaintiff’s face value KRW 1.6 million, the issue date, January 4, 2016, and March 4, 2016.” G, and the Plaintiff, at the notary office C’s office, drafted a promissory deed (hereinafter “instant authentic deed”).

2. Determination

A. Article 10 of the Act on the Punishment of Acts of Arranging Sexual Traffic provides that a claim against a person who has engaged in an act of arranging sexual traffic or a person who has employed a person who has engaged in an act of selling sex with respect to the act of arranging sexual traffic shall be null and void regardless of the form or title of the contract. The illegal consideration as stipulated under Article 746 of the Civil Act refers to a case where the act of causing sexual intercourse is contrary to good morals and other social order. Since the act of inducing and coercing sexual intercourse is contrary to good morals and other social order, money and valuables provided as a means of inducing, soliciting and coercing sexual traffic while employing a person who has engaged in sexual intercourse, and others.
