1. The Defendant’s KRW 18,880,718 as well as the Plaintiff’s KRW 5% per annum from May 11, 2015 to November 17, 2017.

1. Facts of recognition;

A. On April 22, 2014, the Plaintiff, a contractor, entered into a contract with the Defendant, who is the contractor, to newly construct the D’s Second Logistics Center (hereinafter “instant building”) that the Plaintiff’s representative (hereinafter “instant construction contract”) on the following six parcels: (a) the construction cost of KRW 1,650,000,000 (excluding value-added tax) and the construction period from April 22, 2014 to June 8, 2014 (hereinafter “instant construction contract”); and (b) the instant construction contract included the following contents; (c) one copy of the general terms and conditions of the private construction contract and one copy of the statement of cost and aggregate sheet that the Plaintiff, the owner of the instant construction related to the instant construction, contained in each of the following specifications.

The Construction Contract of this case

1. Name of the construction: New construction of the D 2 logistics center (storagehouse);

2. Construction site: Land outside of six parcels in Gyeonggi-do, including the wife C;

3. Date of commencement: The date of completion on April 22, 2014: June 8, 2014: The amount of a contract: daily gold 1,650,000 won (excluding value-added tax) (excluding value-added tax).

6. Contract deposit: 10% of the total contract deposit; and

7. Advance: No one; and

8. A completed amount: A payment of KRW 500 million prior to approval for use shall be made in accordance with the base rate.

9. Balance: To pay a loan within five days after registration for preservation of ownership.

10. Items and quantities of paid materials: A project owner shall settle accounts of the process in which he/she pays or performs materials;

11. Warranty liability (in the case of a complex type of work, divided by type of work) and the rate of warranty for defect compensation for each type of work, and the amount of warranty for defect compensation for the entire defect warranty period of 1,650,000,000 won and 49,500,000 won (3%) and relevant Acts and subordinate statutes: 12. Other matters: 1/100 (Omission) of the daily contract amount per delay; The date of completion shall be determined as the date of official approval for use.
