Defendants shall be punished by imprisonment for four months.

Punishment of the crime

1. On May 2010, Defendant A submitted a letter of guarantee equivalent to KRW 500 million to the NAF to the NAF and intended to be supplied with rice. However, Defendant A was aware of the fact that he did not receive a certificate of guarantee because he did not have any transactional record or any attached security that could be issued with a certificate of guarantee, and attempted to obtain money from the victim by deceiving the issuance of a certificate of guarantee.

In May 2010, the defendant suggested that "the defendant had a security of an amount equivalent to five billion won in Korea" to the victim in the office of the defendant in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul, the defendant used the security of an amount of five billion won in Korea, and there remain two billion won in Korea, and if a guarantee certificate with an amount of five billion won in Korea can be issued sufficiently, it would change the payment of the price if it is issued."

On May 2010, the Defendant stated that “The secured provider would offer a collateral on the face of KRW 75 million, which is 50 million per cent of the KRW 500 million. The Defendant first paid KRW 50 million in advance, and paid KRW 25 million in the face of a sexual death.” The Defendant issued a guarantee certificate within one week on the face of a week.”

Therefore, the victim said that “the victim would pay money in consideration of the situation in which 50 million won is known to the collateral offerer at once,” and the Defendant made a false statement to the victim that “the Defendant would pay KRW 30 million out of KRW 50 million to the collateral offerer at once, and the remaining KRW 25 million would vary if a letter of guarantee is issued.”

However, the Defendant sought a security provider from H introduced through G, and then is issued a guarantee certificate, and only the amount equivalent to 10% of the face value of the security provider shall be paid to the security provider, and there is a demand for a preferential change in the face value of 15 million won.
