According to its reasoning, the court below maintained the judgment of the court of first instance that acquitted the defendant on the ground that the fraud of the facts charged in the instant case constituted a case where there is no evidence of crime.

In light of the records, the above determination by the court below is just, and there were no errors by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal principles on fraud.

On the other hand, although the prosecutor submitted a written appeal to the effect that he/she is dissatisfied with the entire judgment of the court below, he/she did not submit the grounds for appeal

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
