1. The defendant is innocent; 2. The summary of the judgment of innocence shall be published by the defendant.

1. The Defendant is the president of the D organization, and the victim E is the former president of the D organization.

On March 4, 2016, the Defendant sent to 394 exemplary drivers' members of the D organization office located in Cheongju-si, Seo-gu, and the Defendant sent to the victim a document stating that “E is a case granting membership qualification (pro-con voting) following the administrative adjudication of the revocation of the exemplary driver’s license,” which the Defendant sent to the victim, “E was sent to the addressee’s family at least a half of the total thousands of families, was sent to the nearest female members, and had maintained internal relations;

There is a fact that 1 million won has been paid for the crime of injury by using violence against women in the course of performing the position of the president of the branch of the D organization.

The sending was accompanied by a written answer.

Accordingly, the defendant has damaged the reputation of the victim by openly pointing out facts.

2. Determination

A. According to the evidence duly admitted and examined, the following facts can be acknowledged.

1) On September 18, 2014, upon receipt of a summary order due to an injury to women in internal relations while in office as the president of the branch of a D organization, E was sentenced to a fine of KRW 1 million on September 18, 2014, and the judgment became final and conclusive on March 13, 2015, upon dismissal of both E’s appeal and final appeal.

2) On July 21, 2015, the head of the G police station revoked E’s exemplary driver qualification on the ground that he/she was subject to criminal punishment against social criticism after the said judgment became final and conclusive.

3) AD organization maintained its next system of acting as the vice-chairperson, and decided to appoint a special election by the operating committee. On December 22, 2015, the Defendant was elected as the vice-chairperson in a special election.

4) E filed a request with the Central Administrative Appeals Commission to revoke a driver qualification, and the Central Administrative Appeals Commission was punished on January 12, 2016 by exercising violence in the course of conflict with women inside the Republic of Korea, but is an exemplary driver.
