1. The Defendants jointly combine with the Plaintiff KRW 120,000,000 and with respect thereto, from April 17, 2015 to April 24, 2015.
Reasons
1. Facts of recognition;
A. Defendant B issued, on October 11, 2014, a promissory note amounting to 30,000,000 won at par value, and on April 15, 2015, the date of payment prior to the place of payment, and thereafter delivered to Defendant C a promissory note that was made by the Defendant C. Defendant C endorsed endorsed on October 15, 2014, and delivered it to the Plaintiff. The said promissory note was presented at the place of payment on April 15, 2015, but the Plaintiff refused to pay due to the shortage of deposits.
B. On October 20, 2014, Defendant B issued and delivered to Defendant C a promissory note with a face value of 30,000,000,000 won at the face value on April 25, 2015, the payment was made prior to the place of payment, the late branch of the National Bank, the National Bank employees, the late branch of the National Bank, and the payee C. On October 20, 2014, Defendant C endorsed endorsed the said promissory note and delivered it to the Plaintiff. The Plaintiff presented the said promissory note at the place of payment on April 17, 2015, but the payment was refused due to non-transaction.
C. On November 20, 2014, Defendant B issued and delivered to Defendant C a promissory note with a face value of 30,000,000 won at the face value, and on May 19, 2015, the payment was made prior to the date, May 19, 2015, the payment was made, the Korean Bank’s discount branch, and the recipient C. The Defendant C endorsed endorsed it on November 20, 2014, and delivered it to the Plaintiff. The Plaintiff presented the said promissory note at the place of payment on April 17, 2015, but the payment was refused due to non-transaction.
On January 10, 2015, Defendant B issued and delivered to Defendant C a promissory note with a face value of KRW 30,000,000, and the due date on July 9, 2015, the payment was made prior to the due date, the Korean Bank’s discount branch, the Korean Bank’s discount branch, and the payee C. The Defendant C endorsed endorsed on January 10, 2015, and delivered it to the Plaintiff. The Plaintiff presented the said promissory note at the payment place on April 17, 2015, but the payment was refused as non-transaction.
