A defendant shall be punished by imprisonment for six months.

Punishment of the crime

Around September 2013, the Defendant, which was known to the general public, sought a change in the degree of disability by a victim C with mental disability Grade III, which was known to the general public, with a view to recognizing the victim’s personal connection, insurance history, etc., which was the head of the Si/Gun/Gu, and by deceiving the victim through deceptioning that the change in the degree of disability can be caused by the victim’s disability.

1. On September 3, 2013, the Defendant involved in the disability grade review refers to a false statement that “Around September 3, 2013, the Defendant was issued KRW 1 million in cash from the victim’s seat, i.e., a teacher of the F insurance company who conducts a review on the change of the victim’s disability through an employee of the insurance company, on the ground that he/she was the director of the former insurance company, even though he/she did not have the intent or ability to undergo a review on the change of the victim’s disability,” and that he/she was issued KRW 1 million in cash from the victim’s seat.

As a result, the Defendant received money from the victim by deceiving him and received 7,50,000 won in total from the victim six times from July 31, 2014, as shown in the list of crimes (1).

2. On January 9, 2014, around 15:32, 2014, the Defendant was issued KRW 1.2 million in cash from the victim, namely, the victim, who had no intention or ability to give him/her employment, on the part of the H station located in Songpa-gu Seoul Metropolitan Government, on the part of the Defendant.

Accordingly, the Defendant, including deceiving the victim and receiving money from the victim, received a total of KRW 16,20,000 from the victim four times from around that time to August 4, 2014, as shown in the List of Crimes (2).

3. The Defendant who attempted to commit fraud is around December 26, 2013, and around 20:20.
