1. Facts of recognition;
A. Defendant D is a personal entrepreneur engaged in construction machinery leasing business in the name of “F”, and is the owner of G 250 tons mobile flag (hereinafter “instant scrap”). Defendant E Co., Ltd. (former trade name referred to as “Co. H”; hereinafter “Defendant E”) is a construction machinery lessee registered as the place of use of the instant scrap and affiliated leasing company, for which Defendant D’s access to and use of the instant scrap from Defendant D, and Defendant Scex (hereinafter “Defendant Scex”) entered into a verbal agreement (hereinafter “instant lease agreement”). around July 2012, Defendant Scex (hereinafter “Defendant Scex”) is a construction machinery lessee who entered into a construction machinery rental agreement (hereinafter “instant lease agreement”).
