The defendant's appeal is dismissed.

1. In the beginning of the gist of the grounds for appeal, the Defendant and C agreed to exchange the land of 238 square meters and 321 square meters prior to D, owned by C, among the land of 238 square meters and 83 square meters prior to F, in Ansan-si, E, the Defendant’s ownership (hereinafter “Defendant’s one land”). Unlike the above agreement, C voluntarily agreed to register the transfer of ownership of 510 square meters and 2 land out of Defendant’s one land. Unlike the above agreement, C made a false sales contract, etc. that the Defendant agreed to pay the land of 12 million won and to acquire the land of 12 million won, which is larger than C’s land, and acquired the Defendant’s land, and thus, C did not have any capacity to pay the above land price of 12 million won, and thus, C did not file a criminal complaint with the investigative agency as to the ownership transfer of 51 million square meters and 20 million won of the Defendant’s land.

(2) On December 14, 2005, the Defendant made a real estate sales contract to pay KRW 5 million to the Defendant on December 14, 2005 in relation to the land exchange contract as stated in the facts of the crime in the judgment below, which is the following facts in full view of the evidence duly admitted and examined by the lower court. The Defendant and C, as to the land exchange contract as stated in the judgment of the lower court, prepared a real estate sales contract to pay KRW 7 million to the Defendant on December 21, 2004, and the Defendant was directly posted on the contract. ② According to the result of seizure and search conducted by the prosecution, upon the search and seizure, the Defendant directly posted on the contract, KRW 1 million on December 21, 2004, five cashier’s checks issued in the Gold Bank Account (Account Number I-H) was deposited into the Defendant’s new bank account in the Defendant’s second ASEAN, and the Defendant’s check number 1-6 million on February 14, 2005.
