Reasons
1. Facts of recognition;
A. From April 14, 2009, the Plaintiff owned each real estate listed in [Attachment 1 to 15] list of real estate from April 14, 2009.
B. On December 7, 2012, Defendant A is Nonparty E and F [this refers to the “H” located in Dongdaemun-gu Seoul, an aggregate building (hereinafter “H”).
() From H’s 1st underground floor (the representative of the first floor of the commercial building management body) leased each real estate other than the real estate listed in the Disposition No. 1 (hereinafter “instant real estate No. 1”), among H underground floors, for a private letter or use (hereinafter “instant lease contract”). The Defendant A occupies the entire H 1st underground floor, including the instant real estate, from December 20, 2012 to the present day, as the time when the interior construction can be commenced at the time of the said contract.
C. On April 17, 2013, the Defendant (Appointed Party; hereinafter “Defendant B”) jointly leased each of the real estate, other than the real estate listed in Section 2-A of the Disposition No. 2 from Nonparty I, J, K, and L (this refers to the representative of H shopping district management body 7 through 9, and the Chairperson) on April 17, 2013 (hereinafter “instant Second Lease Contract”). Meanwhile, Defendant B asserted that each of the above 7 through 9 stories was leased from all the owners of the partitioned buildings of the H7 through 9 stories, etc., who was authorized to lease from all the owners of each of the divided buildings of the H7 through 9 stories, but the lessee separately agreed to lease the above 7 through 9 stories of the instant case’s lease agreement (hereinafter “construction agreement”).
In light of the fact that the above argument is written, it is difficult to accept it.
Three parties, including Defendant B, occupy the entirety of H7 to 9 floors, including the instant 2 real estate, from the same date to the same date.
On the other hand, the appraiser on the rent of the second real estate in this case.
