피고인은 2012. 9. 6. 15:45경 서울 B빌딩 7층 소재 피해자 C이 근무하는 D 서비스센터에서 그의 직장동료들이 있는 자리에서 “C은 나이든 사람에게 욕설을 서슴지 않고 빌라 주민 및 동네 주민들로부터 평판이 안 좋은 사람이다. 고소인은 낮에도 집안에 커튼을 치고 살고 있는 등 정신적으로 문제가 있다. 위층을 쫓아내려고 쿵쿵 소리를 내며 잠을 못 자게 한다. 오토바이 넘버도 없이 다니고 있다.”라는 말을 하여 공연히 사실을 적시하여 피해자의 명예를 훼손하였다.
