A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant is a person engaging in driving a franchise-low-income vehicle in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes;
On June 14, 2013, at around 08:35, the Defendant driven the said car under the influence of alcohol with 0.195% of alcohol content 0.195%, and led to the running of the said car at a fluent speed from the front side of the two ambridges in front of the two ambi-dong in the front Eup/Yan-dong.
At all times, the victim D(49 years of age) was walking along according to the right edge of the defendant's proceeding direction, so in this case, there was a duty of care to thoroughly prevent the accident to be driven safely by the driver of the vehicle.
Nevertheless, while under the influence of alcohol, the Defendant had the victim go beyond the land by shocking the victim's leg part on the front right side of the driver's vehicle with the negligence of driving in a sudden manner without neglecting the front city.
Even though the Defendant suffered from an injury of an unexplosion in the treatment days of treatment due to occupational negligence, the Defendant immediately stopped and escaped without taking measures such as aiding the victim.
2. On June 14, 2013, at around 08:35, the Defendant: (a) driven a C-do motor vehicle under the influence of alcohol content of approximately 0.195% in a section of about 8km from the front of the KNUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUU.
