1. The Defendant shall pay to the Plaintiff KRW 500,00,000 and the interest rate of KRW 15% per annum from May 21, 2016 to the date of full payment.
Reasons
1. Presumed factual basis
A. The Plaintiff is a person who enters into an agreement on the consignment breeding with the Defendant and raises the breeding family in the Plaintiff’s farm (hereinafter “instant farm”).
The defendant is a corporation established for the purpose of business, etc. concerning the production of eggs, such as incubation, breeding, and mooring.
B. The Defendant, such as the issuance of an electronic bill, issued an electronic bill (hereinafter “each of the instant bills”) to pay the Plaintiff for the breeding fund entrusted to the Plaintiff as follows:
Serial No. 60,000,000 Plaintiff B 2, Sept. 18, 2015, 2015, the due date of issuance of the Promissory Notes (won) on September 24, 2014, and Plaintiff C C on September 22, 2015, Sept. 22, 2015, 2015: (a) 60,000,000,000 Plaintiff C on September 24, 2014; (b) 10,00,000,000 on September 3, 2014, 2015; and (c) 10,00,00,000 Plaintiff E on May 10, 2015; and (d) Plaintiff C on October 10, 2014; and (e) Plaintiff 10, Oct. 10, 2015, 2005
C. The Plaintiff, including the offer of the instant farm as collateral, offered the instant farm as collateral for the Seocho Feed with a view to securing the Defendant’s obligation to pay for the feed to the Seocho Feed Co., Ltd. (hereinafter “Seo Seo Feed”).
The Defendant issued an electronic bill (hereinafter “each of the instant notes”) for the payment of the feed price for the Seocho Feed as follows, and the Plaintiff endorsed each of the instant notes on the respective feed price.
